A&T over $200,000 in liquidated damages. Liquidated damages refers to a certain amount of money that must be paid when there is a breach in the contract. Thanks also captaggie , finally we get some official information concerning this debacle. Its very true when he said this was the first late project in 12 years. The demolition of Scott Hall and construction of Aggie Village was the largest project to date in my mind ,and that was completed on time. Now that I have read the financial agreement , I'm cool. At the rate of ten grand a week , we will be alright money wise . There's no way it will be complete by the 25th , and i understand Perkin's logic for not firing them outright, that would have delayed it much longer. They are working and making progress , just at a much slower pace. My only hope now is that it be finished , inspected , and ready for use by the beginning of the 2012 season.

Vice-Chancellor Andrew Perkins does not need to speak another word to the press because he is a terrible spokesman for the University. In September he stated the Press Box would be finished in a few weeks when everyone with eyes knew it had a few months to go. Now he is stated that the Press Box will be finish in a week when there is clearly weeks of work left. A spokesperson must have some credibility and Perkins has none.
This project has gone from $3.7 million to $4.2 mil to $5 million project and counting. How can A&T collect damages from this company, when this company is 5 months behind and had to make payroll for that period of time to keep the project going? I see bankruptcy in this company's future which means no money for A&T or a long term payout agreement to A&T.
A&T has stopped posting their monthly construction progress reports. The last one was in October 2011.
The original press box proposal had this project as a 10-month project why the current A&T administration thought it could be done in 5 months is beyond me.

I suspect Perkins announced the next agreed upon due date for legal reasons which also keeps the pressure on Kenbridge.

I think it was said it wouldn't be finished until the outdoor track season anyway. This is nothing new!

What he stated was that was the next target date, meaning they will owe us another late fee. We should not have to go after them because the late fees will be deducted from the total. Payments to a contractor are made in installments. Just like when we are late with a bill, the late fee is added for that payment. In construction its the same thing all late fees or penalties should be deducted from any payments. You don't pay someone in full when its already documented they owe something in return , and then go after them .

I don't know if A&T has exercised that penalty clause and back in Oct, Perkins stated that A&T had not exercised the clause.
I am not sure who will be left getting hit in the pocket at this point but like I said back in August, what legitimate construction company would have signed a contract like the one Kenbridge has. This project was too big to be done in half the time it is normally done.
Why is the cost rising throughout this project on A&T's financial book?

The rising cost could be due to change orders. If the change orders were initiated by NC A&T then it voids the initial completion date penalty clause. There could be legitimate cost overruns but what was reported in The Register, it seems like these overruns or delays were caused by incompetence from the construction company. Lets not talk about the weather because not taking into account the summer weather in the southeast region is poor planning by the general manager. The idea that A&T can't get screwed financially because of installment payments is not true. Delays can cost both the builder and the customer financial losses. The customer can definitely lose money if the builder is incompetent.
