Seems like they found a smoking gun with the duplication of programs argument. I am not sure we would be that fortunate. It may backfire on us…we may be duplicating some of the same programs UNCG has. Especially the MBA program and our planned PhD programs. Our MBA program was just the redesignation of our MSM program. We had originally submitted a program proposal for a new MBA program that was hospitality focused to address the duplication of programs. We have the JMSW and Joint PhD in Social program with North Carolina Women's College of Greensboro. But we likely could argue for underfunding easily but looking at the lack of land-grant match monies over the years in comparison to NCSU. There are enough documents in archives around the state that will clearly show how we had to move monies around to at least meet the minimums from certain monies like Evans-Allens capacity grants, etc.

How does this affect our efforts to sue NC for $2.8 billion? Any real effort to do a legal action wouldn't come from the alumni chapters even more now than before. It would come from a non-affiliated entity like the old North Carolina Alumni and Friends Coalition. If a corporation for an alumni association is re-established, there are very specific guidelines in the UNC System policy for affiliated entities and at any moment, the institution can yank its affiliation and trigger the dissolution of the legal entity. So that means the BDF probably needs to lead the charge. No other alumni group has our autonomy. This is what we've been preparing for all these years.

It would come from a non-affiliated entity like the old North Carolina Alumni and Friends Coalition. If a corporation for an alumni association is re-established, there are very specific guidelines in the UNC System policy for affiliated entities and at any moment, the institution can yank its affiliation and trigger the dissolution of the legal entity. So that means the BDF probably needs to lead the charge. No other alumni group has our autonomy. This is what we've been preparing for all these years. Yes, a group like BDV, Aggie Gents, Ladies of A&T are great pathways to build a coalition that could mount a legal challenge in federal court. It would be wise to talk to the Maryland coalition, because there will be little support from the institution to appear "independent." I know Dr. Battle isn't everyone's favorite former chancellor, but he would be a person to talk to along with Dr. Fort (granted he is still employed by A&T as faculty and special assistant to the chancellor) to get insight. Also Tommy Ellis, former VC for Business and Finance (and later Associate Dean, School of Agriculture and Environmental Sciences during the Battle years). I will always say, talk to Velma Speight. She's been on all the sides of all of this from the NCAFC, A&T staff, and later A&T Board.

Addressing Historic Underfunding of HBCUsThis policy brief series talked through the land-grant underfunding and in the last two briefs which just came out this week focus two specific examples from the Maryland litigation and pending Tennessee legislation.
